TERMS AND CONDITIONS

Hereinafter known as Lessee: In return of approved, completed contract with submitted fees, Lessor agrees to provide Lessee with space at the Centralia Balloon Fest where Lessee agrees to prepare and sell the following products in a manner which conforms to a minimum to the health standards outlined within the contract. Please fill out registration form completely.

IMPORTANT-PLEASE READ CAREFULLY

ICE CANNOT BE BROUGHT INTO THE PARK BY ANY FOOD VENDOR except to initially pack coolers that contain perishable food items. ICE MAKERS WILL NOT BE ALLOWED FOR ANY REASON DUE TO POWER LIMITATIONS. Bags of ice MUST be purchased ON SITE from a commissary operated by the ice vendor. Cash will be required at the time of purchase. Size and cost will be posted. Power is such that IF THERE ARE ANY VIOLATIONS, YOUR BOOTH WILL BE SHUTDOWN and will not be allowed to return to future events. If you are shut down, you will also forfeit all vendor fees and you will not be allowed to dismantle or leave the park prior to the end of the day and have been cleared and escorted by the Executive Committee. IF ANY ICE IS BROUGHT INTO THE PARK, YOU WILL BE CHARGED $1.00 PER BAG BASED ON AN ESTIMATED 10 LB. BAG. This restriction will be strictly enforced.

1. INSURANCE: Lessee Must provide the Lessor with a Certificate of Insurance indicating product and general liability (Minimum $1,000,000 general liability), and naming the Greater Centralia Chamber of Commerce, its of icers and directors, the Centralia Foundation and the City of Centralia as additional insured. (Copy of liability insurance must be received at the Chamber office no later than 7 days after acceptance showing that insurance coverage is effective for the time of the event. If liability insurance renews after March 31, but prior to August, submit proof of insurance with contract and forward the renewal certificate prior to the event. If Certificate is not received, the vendor will not be allowed to set up his booth.

2. Lessee is responsible for the security of his equipment, product and/or personal effects during the Balloon Fest. Lessor takes no responsibility for any losses incurred through theft, carelessness, force majeure, riots, weather, etc.

3. Lessee must provide Lessor with a booth diagram at time of contract indicating equipment layout, anticipated display/decorations and electrical needs. All booths must have 3 sides enclosed. Any booths selling food or beverage must have an overhead cover.

5. Lessee agrees that this contract is only for the lease of space and that Lessee is acting as an independent contractor, not as an employee or agent of Lessor.

6. In the event any clause(s) of this contract is declared by a court of law to be void and unenforceable, the remaining clauses and terms shall remain in full force and effect.

7. This Contract is subject to the laws of the State of Illinois and the proper venue for any legal actions shall be in the County of Marion or the corresponding United States District Court.

8. No political decorations, literature, campaign materials, or soliciting will be allowed. No advertising/signs for alcoholic beverages.

9. Lessee shall police all areas immediately surrounding booths to avoid accumulation of trash and residue. Lessee should provide trash bags and containers within his booth to maintain an acceptable sanitation level. All trash shall be taken by Lessee to a main dumpster, not in roadside barrels.

10. Lessee agrees to cover food with foil or lids so it is not exposed to flies, bugs or dust.

11. NO home-canned foods are permitted.

12. NO animals are permitted within the park.

13. Smoking is not permitted within the booth perimeter. Workers must step outside of the food area to smoke.

14. All booths must have a water container, soap, and paper towels for workers to wash hands and utensils. A diluted chlorine bleach solution makes a satisfactory disinfectant for utensils and working areas.

15. Workers must wear plastic gloves when handling food or ice.

16. Lessee’s workers may not handle food if they have cuts or sores on hands, arms or face; if they have a cold, sore throat or diarrhea; if they are not clean or appear unhealthy.

17. Caps, visors or hair nets should be worn by food servers and preparers.

18. All food temperatures must be maintained at a minimum of 140 degrees for hot foods and 45 degrees for refrigerated foods.

19. Cooking fires are restricted to grills. Fire boxes must be 24 inches off the ground and on protective ground cover, i.e. plywood, etc.

20. All vendors must follow applicable laws and health department regulations.

21. Alcoholic beverages are NOT permitted in Foundation Park. Glass bottles and aluminum cans are NOT permitted.

22. ELECTRICITY for vendors will be available. Power generators permitted ONLY in the event of a power failure. CONNECTION CORDS MAY NEED TO BE UP TO 100 FT. IN LENGTH AND MUST BE S.O. CORD AND A MINIMUM OF 12 GAUGE WIRE FOR 110V. NO MORE THAN 20 AMP SERVICE WILL BE ALLOWED WITHOUT ADVANCE CLEARANCE BY BALLOON FEST FOOD COMMITTEE. ALL EXTENSION CORDS AND CONNECTIONS MUST MEET CURRENT NEC STANDARDS.

23. Potable water for vendors will be available. Food-grade hose may need to be 100 ft. in length to connect.

24. Lessor will provide trained personnel to assist in the connection and disconnection to the furnished electricity. No Lessee shall connect to or disconnect from the electrical outlets.

25. Each vendor is responsible for his/her own collection and remittance of any appropriate sales tax.

ICE MAKERS WILL NOT BE ALLOWED FOR ANY REASON due to our power limitations. Bags of ice cubes MUST be purchased ON SITE from a commissary operated by the ice vendor. Cash will be required at the time of purchase. Size and cost will be posted. Power is such that IF THERE ARE ANY VIOLATIONS, YOUR BOOTH WILL BE SHUT DOWN and will not be allowed to return to future events. If you are shut down, you will also forfeit all vendor fees and

damage deposits AND you will not be allowed to dismantle or leave the park prior to the end of the day and have been cleared and

escorted by the Executive Committee. This restriction will be strictly enforced. IF ANY ICE IS BROUGHT INTO THE PARK,

YOU WILL BE CHARGED $1.00 PER BAG BASED ON AN ESTIMATED 10 LB. BAG.

27. All tables, chairs, etc. for the booth must be provided by Lessee.

28. Lessee will provide a 5 lb. BC fire extinguisher at any facility involved in cooking operations. A minimum of one fire extinguisher

having at least a 2-A rating is required for all other booths.

29. Designated fire lanes must be kept clear at all times – both sides of the food row.

30. All supply vehicles MUST be removed from the park by 1:00 p.m. on Friday, and by 9:30 a.m. on Saturday and Sunday. No vehicles are permitted on the park grounds during the event unless they are part of your booth and have been approved. All refrigerated trucks and food storage vehicles that have been approved to remain in the park MUST be parked along the tree line east of the vendor area or at such place as the Balloon Fest Executive Committee requires. If Lessee is utilizing refrigerated vehicles or food storage vehicles, please complete the form on page 2 (under Electricity Request and Connection).

31. Specific access and parking instructions will be provided prior to the event. No vehicles are allowed in the park during event times. This is for the safety of attendees.

32. ALL booths MUST be set up by Friday between 8:00 a.m. and 12:00 p.m. and ready for inspection by the Marion County Health Dept. at 1:00 p.m. Gates will open at 3:00 p.m. There will be NO additional booth set-ups allowed on Saturday or Sunday.

33. Lessee will NOT be permitted to dismantle and/or remove concession booth/equipment prior to 4:00 p.m. on Sunday without permission of the Balloon Fest Executive Committee.

34. Lessee must be prepared to leave the park within 30 minutes of the close of Friday and Saturday night's events so the park can be closed down and security can be put in place.

SCHEDULE / HOURS OF OPERATION:*

Thursday, August 16 - EARLY SET-UP - A request must be made in advance to the Centralia Chamber to set-up on Thursday.

Friday, August 17

8:00am - 12:00pm - Check-in with Food Committee. Booth spaces will be assigned. Admission wristbands, and parking passes will be given at check-in. Additional parking passes and wristbands may be purchased at $5 each.

1:00pm - All vehicles must be out of the park and parked in vendor parking (Pleasant Street).

3:00pm - Balloon Fest officially begins! Food Committee may not be allowed to transport vendors during peak times, make sure your booth is well stocked.

10:00pm - Balloon Fest closes.

Saturday, August 18

3:00pm - Balloon Fest opens.

10:00pm - Balloon Fest closes.

Sunday, August 20

12:00pm - Balloon Fest opens.

6:00pm - Balloon Fest ends. After packing up, please check that your space and immediate surrounding area has been restored to its condition prior to the event.
